Terms & Conditions
Please read these Terms & Conditions carefully before using our website or booking any services.
By accessing or using Carpe Diem’s website and yacht rental services, you agree to be bound by the terms outlined below. These terms are designed to ensure a clear understanding between you (the client) and us (Carpe Diem), so your experience is smooth, transparent, and enjoyable.

Booking and Payment

A reservation is confirmed upon receipt of a deposit or full payment. The deposit represents 30% of the total rental price.

The remaining balance is due 72 hours before the charter date. If the final payment is not received within this time frame, Carpe Diem reserves the right to cancel the reservation and retain the deposit.

Accepted payment methods include wire transfers, online payments, and cash.

1.4. Online payments made via PayPal or credit card are subject to a 5% surcharge to cover processing fees. Cash and bank wire transfers do not incur additional fees.

1.5. Chargebacks initiated without prior communication and a valid reason will be considered a breach of contract. In the event of an unjustified chargeback, Carpe Diem reserves the right to pursue legal action and impose a $45 USD (900 MXN) administrative fee. The client will be responsible for all related legal and processing costs. Clients are encouraged to contact Carpe Diem directly to resolve any disputes before initiating a chargeback.
Late Arrival

Clients must arrive at the agreed embarkation point on time. A 5-minute grace period is allowed.

Late arrivals beyond the grace period will not result in an extension of the rental time, and the full booking amount remains due.

Early returns do not qualify for refunds.
Cancellation & Rescheduling Policy
-
Cancellations made more than 30 days prior to the charter date will receive a full refund, minus a $45 USD (900 MXN) administrative fee.

Cancellations made 8 to 30 days before the charter date will receive a 50% refund, or clients may reschedule subject to availability and operational costs, plus a $45 USD (900 MXN) administrative fee.

Cancellations made within 7 days of the charter date are non-refundable. Clients may reschedule within 12 months, subject to availability, operational considerations, and a $45 USD (900 MXN) administrative fee.

Cancellations made within 72 hours of the charter date (after final payment) are non-refundable. Rescheduling may be allowed at Carpe Diem’s discretion, subject to availability and the administrative fee.

Rescheduling fees are determined at the time of request based on operational costs.
-
Processing fees for online or credit card payments are non-refundable.
No-Show Policy

A client is considered a no-show if they fail to arrive within 30 minutes of the scheduled departure time without prior notice.

4.2. No-shows forfeit the full booking amount, with no refunds provided.
Captain, Crew & Fuel
Safety Regulations
-
All guests must follow safety instructions from the captain and crew. Inappropriate behavior, including excessive alcohol consumption, will not be tolerated.
-
Illegal activities or substances are strictly prohibited and may result in immediate termination of the charter without a refund.
-
Clients are encouraged to obtain travel insurance.
-
Environmental guidelines, including proper waste disposal, must be followed.
-
Swimming and water activities are done at the client’s own risk. Wearing a life jacket is strongly encouraged at all times.
The rental fee includes a licensed captain, crew, and fuel.
Changes by Carpe Diem
-
Carpe Diem reserves the right to modify bookings due to unforeseen circumstances such as mechanical issues or safety concerns.
-
If changes are required, clients will be notified promptly and offered alternatives such as rescheduling, a replacement vessel, or a refund. No additional compensation will be provided.
Force Majeure / Bad Weather
Extension of Booking
-
Extensions are subject to availability and must be requested at least 60 minutes before the scheduled end time.
-
Payment must be made through official Carpe Diem channels. Direct payments to crew are not permitted.
Beach Stopovers
-
Guests must return to the yacht at the time set by the captain.
-
Delays caused by stopovers will be charged as additional hours.
Guest Count
-
The charter is valid for the booked number of guests only.
-
Additional guests incur immediate extra charges.
-
Legal guest capacity limits must be respected.
Seasickness
-
Early termination due to seasickness does not qualify for a refund.
-
Any additional transportation costs are the client’s responsibility.
Damages & Liability
-
Clients are responsible for damages caused by negligence or misconduct.
-
Carpe Diem is not liable for injuries, accidents, or loss of personal belongings.
-
Carpe Diem is not liable for delays or cancellations caused by circumstances beyond its control.
-
Bad weather includes conditions that pose safety risks. Light rain or cloudy skies do not automatically qualify.

Rescheduling & Cancellation for Weather
-
Captain’s Authority: The captain has final authority.
-
Same-Day Reschedule: Allowed at no cost if weather is safe.
-
Different-Day Reschedule: $45 USD admin fee + 70% charge; 30% credited for a future trip (valid 2 years).
-
Unsafe Weather: Full reschedule at no cost.
-
Permitted & Restricted Items
-
Personal items are welcome.
-
Illegal, dangerous, or hazardous items are prohibited.
Parental Responsibility
-
Parents or guardians are responsible for supervising children.
-
Life jackets are strongly encouraged for children and mandatory while swimming.
Confidentiality of Contact Information
-
Clients may not exchange personal contact details with crew. All communication must go through official Carpe Diem channels.
Governing Law
-
These terms are governed by the laws of Mexico.
